Dive Monkey — Terms of Use

These Terms of Use ("Terms") govern your use of Dive Monkey ("the app"), developed by Paweł Wiszenko and Artur Kęsik, trading as Dive Monkey ("we", "us"). By downloading or using Dive Monkey, you agree to these Terms.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Dive Monkey on devices you own or control, for your personal, non-commercial use, consistent with the Apple Media Services Terms and Conditions or the Google Play Terms of Service, depending on where you got the app.

Acceptable use

You agree not to misuse Dive Monkey — including attempting to copy, modify, reverse-engineer, or distribute it except as permitted by law, or using it for any unlawful purpose.

Purchases and subscriptions

Dive Monkey may offer in-app purchases and auto-renewing subscriptions. Payment is charged to your App Store or Google Play account at confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. Manage or cancel subscriptions in your App Store or Google Play account settings. Any unused portion of a free trial is forfeited when you purchase a subscription. Prices may vary by region.

Your account

An account is optional. If you create one, keep your password secure — you are responsible for activity under your account. You keep all rights to the content you add; we use it only to provide the app and sync it to your devices. Sync relies on a third-party service and may occasionally be unavailable, so keep your own copy of anything important. You can delete your account at any time in the app, and we may suspend accounts used to abuse the service.

Not a dive computer

Dive Monkey is a logbook for recording dives after they happen. It is not a dive computer or a decompression or dive-planning tool, and must not be used to plan or conduct a dive. Dive-site and marine-life information is provided for general interest and may be incomplete or inaccurate. Always dive within your training and certification, follow local rules, and rely on proper equipment and professional guidance.

Dive Monkey is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of (or inability to use) Dive Monkey.

Changes

We may update these Terms from time to time. Continued use of Dive Monkey after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence in the EEA.
